Chris Pickett recently obtained a favorable settlement at mediation for an HVAC subcontractor that relocated bathroom exhaust fans to the roof of a high end, lakefront home.  The fans were enclosed on the roof by wooden housings that were not properly sealed at their base and eventually resulted in water infiltration into the home and a $1.1 million claim for damages.   Through an in-depth investigation, he uncovered a handwritten sketch of the modifications that were prepared by the mechanical systems subcontractor in order to accomplish the relocation of the fans.  This sketch established that the modifications to the original plans and specifications were implemented by the mechanical systems subcontractor and though the work was performed by our client, it was performed in strict accordance with the handwritten sketch.  As a result, he negotiated a contribution of only $100,000 from our client towards a $675,000 global settlement.
