Howard Trafman obtained a not liable defense verdict in favor of the defendant driver in a motor vehicle versus pedestrian accident.  The defense successfully argued that Plaintiff was intoxicated when she attempted to cross the street, failed to yield the right of way to a moving vehicle, and saw the vehicle coming but tried to beat it across the street and/or failed to recognize the vehicle was moving toward her due to her intoxication.  Plaintiff sustained fractures to her pelvis, femur, tibia, and L-5 transverse process and claimed $174,900.00 in medical bills.  Plaintiff asked the jury to award $374,900.00. Ward v. Novatney. April 2008.
