Our client, a towing company, struck a pedestrian who was crossing a road at night.  The pedestrian passed away as a result of his injuries.   The entire incident was captured on surveillance video and was detrimental to our defenses.  Plaintiff—the decedent’s son—made an early $1M policy-limit demand. Despite the grim outlook, we undertook a thorough accident investigation, establishing that the decedent was highly intoxicated and crossing the road illegally at the time of the incident. They further investigated the full extent of the decedent’s family background, uncovering the estranged nature of the relationship between the plaintiff and decedent. Chris Pickett and Brendan Ross promptly developed a strong, case-specific defense attacking the extent of plaintiff’s damages based on this estrangement and, despite the impact of the surveillance footage, conducted a pretrial within months of the accident date and settled for $300,000.
