Peter Syregelas recently obtained a summary judgment on behalf of the firm’s liability carrier client finding no duty to defend or indemnify a company accused of violating Illinois’s Biometric Information Protection Act (BIPA) when it required its employees to use a hand-scanning device to clock in and out of work. Judge Celia Gamrath of the Chancery Division had previously ruled against our client, finding that it owed a duty to defend a BIPA class action lawsuit. Following a motion to reconsider, Judge Gamrath reversed herself, vacated the previous judgment, and granted summary judgment in total to our client.

This is the most recent in a string of cases where Peter has secured judgment for the firm’s clients in BIPA-related insurance coverage litigation. LPP appreciates the Court’s willingness to revisit this decision and applauds Peter’s tenacity in seeking reconsideration.
