Steve Becker’s Exceptional Efforts Allow Insurer to Recoup Worker’s Compensation Lien
In a multi-party construction case, Steve Becker successfully fended off two breach of contract claims (for failure to procure insurance and failure to indemnify) and recovered $187,500 on behalf of our client and insurance carrier. Steve represented the employer of an operating engineer who injured himself while setting up his machinery to pour concreate at a jobsite. The Plaintiff allegedly tripped over construction debris, causing a heavy pipe to land on his foot and resulting in serious injuries.
Steve argued that our client complied with all material aspects of their contract; that they substantially satisfied all of their insurance obligations; that the indemnity clause was not valid; and that there was no evidence to support a finding of negligence on the part of our client, in the contribution actions filed by the direct defendants. As a result of Steve’s efforts, our client was able to make a substantial recovery on their worker’s compensation lien.
