Syregelas Earns Summary Judgment Victory in Cook County Coverage Action
LPP secured a complete summary judgment victory in the Circuit Court of Cook County, Illinois, obtaining a final ruling that our client owed no duty to defend or indemnify in a putative FACTA class action.
The underlying suit alleged improper printing of credit card information on receipts, with the defendant seeking coverage as an additional insured under a businessowners policy.
Through focused briefing and oral argument led by Peter Syregelas, our firm demonstrated that: (1) the additional insured endorsement limited coverage to “bodily injury” and “property damage,” neither of which was alleged; (2) the claims fell squarely within multiple exclusions, including the Violation of Law exclusion (expressly encompassing FACTA) and the Access/Disclosure of Confidential Information exclusion; and (3) the contractual liability exclusion independently barred any claimed obligation.
The Court adopted these arguments in full, finding the exclusions clear and dispositive, and entered final judgment for our client.
